TERMS AND CONDITIONS OF THE ANNOUNCEMENT SERVICE www.go-philippines.com

I. Definitions
 
The terms used in the Regulations shall mean:
 
1) User - a natural person, a legal person or an organizational unit which is not a legal entity and whose special regulations grant legal capacity, which performs the Order within the Announcement Service;
 
2) Civil Code - Act of 23 April 1964 (Journal of Laws No. 16, item 93, as amended);
 
3) Regulations - these Rules of Providing Services by Electronic Means as part of the ad service

4) Announcement Service - an Internet service available at www.go-philippines.com, through which the User may in particular place Orders;
 
5) Service - products presented in the ad service;
 
6) Contract of sale - a contract of sale of Goods within the meaning of the Civil Code, concluded between Go-Philippines and the User, concluded with the use of an advertisement service;
 
7) Act on special conditions of consumer sales - Act of 27 July 2002 on special conditions of consumer sales and amending the Civil Code (Journal of Laws No. 141, item 1176 as amended);
 
8) Act on the rendering of services by electronic means - Act of 18 July 2002 on the rendering of services by electronic means (Journal of Laws No. 144, item 1204, as amended);
 
9) Order - a statement of the User's will, aiming directly to conclude a Sales Agreement, specifying in particular the type and number of the Goods.
 
II. General provisions
 
2.1 These Terms and Conditions define the rules of using the ad service available at
www.go-philippines.com
 
2.2 These Terms and Conditions are the regulations referred to in Article 8 of the Act on electronic services.
 
2.3 The Announcement Service, operating at www.go-philippines.com, is operated by Go-Philippines.
 
2.4 These Terms and Conditions specify in particular:
 
a) the rules of registering and using the account within the Announcement Service;
 
b) the terms and conditions for making electronic booking of products available on the Advertising Service;
 
c) the terms and conditions for rendering Services in the Advertising Service by electronic means;
 
d) the rules of concluding Sales Contracts using services provided within the Announcement Service.
 
2.5 Use of the Advertising Service is possible on condition that the following minimum technical requirements are met by the information and communication system used by the User:
 
a) Internet Explorer Version 9 or later with Java and flash player enabled, or
 
b) Mozilla Firefox or Opera with Java and flash player enabled,
 
c) a minimum screen resolution of 800 X 600 pixels.
 
2.6 In order to use the Advertising Service, the User should gain access to a computer workstation or terminal device with Internet access on their own.
 
2.7 In accordance with the applicable legal regulations, Go-Philippines reserves the right to limit the provision of services by means of the Advertising Service for persons who violate the regulations of the service. In this case, prospective Users will be notified of the above.
 
2.8 Users may access these Terms and Conditions at any time through a link on the home page of the website www.go-philippines.com/regulamin.html and download and print it out.
 
2.9 Information about the Services provided on the website of the Announcement Service, in particular their descriptions, technical and usable parameters and prices, constitute an invitation to conclude a contract within the meaning of Article 71 of the Civil Code.
 
III. Rules of using the Advertising Service.
 
3.1 In order to start using the Announcement Service, it is necessary to register within it.
 
3.2 Registration takes place by filling in and accepting the registration form, which is made available on one of the websites of the Announcement Service.
 
3.3 The condition of registration is consent to the content of the Terms and Conditions and providing personal data marked as obligatory.
 
3.4 Go-Philippines may deprive the User of the right to use the Advertising Service, and may also limit his access to part or all of the resources of the Advertising Service, with immediate effect, in the event of a User's breach of the Regulations, and in particular when the User:
 
a) in the course of registration with the Announcement Service, provided data that is incorrect, inaccurate or outdated, misleading or infringes the rights of third parties,
 
b) has committed, through the Advertising Service, a violation of personal rights of third parties, in particular the personal rights of other users of the Advertising Service,
 
c) has committed other conduct that is found by Go-Philippines to be inconsistent with applicable laws or general principles of using the Internet, or to harm the good name of Go-Philippines.

3.5  A person who has been deprived of the right to use the Advertising Service may not re-register without the prior consent of Go-Philippines.
 
3.6 In order to ensure the security of the transmission of messages and data in connection with the services provided within the Site, the Announcement Service shall take technical and organizational measures appropriate to the degree of threat to the security of the services provided, in particular measures to prevent the acquisition and modification by unauthorized persons of personal data transmitted on the Internet.
 
3.7 In particular, the user is obliged :
 
a) not to provide or transmit content prohibited by law, e. g. content promoting violence, defamatory or derogating from personal interests and other rights of third parties,
 
b) to use the Advertising Service in a manner that does not interfere with its functioning, in particular through the use of specific software or equipment,
 
c) not to take any action such as sending or posting unsolicited commercial information on the Advertising Service (spam),
 
d) use the Advertising Service in a manner not burdensome for other Users and for Go-Philippines,
 
e) use any content posted on the Announcement Service for own personal use only,
 
f) use the Announcement Service in a manner consistent with the provisions of law in force in the UK territory, the provisions of these Terms and Conditions, as well as with the general principles of using the Internet.

IV. Procedure for concluding the sales contract
 
4.1 In order to conclude a Sales Agreement through the Advertising Service, the user should visit the website www.go-philippines.com, make a selection of an advertisement, taking further technical steps based on the messages displayed to the User and the information available on the website.
 
4.2 Selection of the Services ordered by the User is made by their approval and redirecting the user to the payment page.
 
4.3 During placing an Order - until "Go to Payment" button is pressed – the user can modify the entered data and select the Service. For this purpose, follow the messages displayed to the User and the information available on the website.
 
4.4 After the User who uses the Advertising Service provides all necessary data, a summary of the placed Order will be displayed. The summary of the submitted Order will contain information on the following:
 
a) the subject-matter of the contract,
 
b) the unit and total price of the products or services ordered, including delivery costs and additional costs (if any),
 
c) the chosen method of payment,
 
4.5 Sending an Order by the User constitutes a statement of intent to conclude a Sales Agreement with Go-Philippines, in accordance with the provisions of the Regulations.
 
4.6 After placing the Order, the User receives an e-mail with final confirmation of all important elements of the Order.
 
4.7 The Agreement shall be deemed concluded upon receipt by the User of the e-mail message referred to above.
 
4.8 The sales agreement is concluded in Polish, in accordance with the Regulations.
 
V. Prices and methods of payment
 
5.1 The prices of the Services are quoted in Philippines Peso (PHP) and include all components, including VAT, duties and all other components.
 
5.2 The user has the possibility to pay the price:
 
a) by Paypal payment,
 
b) by credit card using Paypal service,

c) direct transfer onto account bank (contact service provider for more details before purchase)
 
VI. Right of withdrawal from contract
 
6.1 The User, being a consumer within the meaning of Art. 22[1] of the Civil Code, shall be entitled - under the provisions of law - to withdraw from a contract concluded remotely, without giving any reason, making an appropriate statement in the form of an e-mail within 10 days and sending it to the e-mail address provided in these Terms and Conditions.
 
6.2 A period of 10 days shall run from the date on which the Service is provided.
 
6.3 The consumer's right of withdrawal is excluded in the case of a contract:
starting - with the consumer's consent - the rendering of services by the Advertising Service before the expiry of the period of 10 days from the conclusion of the contract services with characteristics specified by the consumer in his or her order or closely related to him or her benefits which, because of their nature, cannot be reimbursed.
 
6.4 In the case of withdrawal from a distance contract, the contract shall be deemed not to have been concluded. What was proved by the parties is returned in the unaltered state, unless the change was necessary within the limits of ordinary management.
The return should take place immediately, not later than within 14 days.
 
VII. Complaints regarding the provision of electronic services
 
7.1 Go-Philippines takes action in order to ensure the correct functioning of the Announcement Service, to the extent resulting from the current technical knowledge and undertakes to remove within a reasonable period of time any irregularities reported by the Users.
 
7.2 The user is obliged to immediately notify Go-Philippines of any irregularities or interruptions in the operation of the  Advertising Service.
 
7.3 Irregularities related to the functioning of the Advertising Service, the may be reported by the User in writing to the following e-mail address: info@go-philippines.com
or by using the contact form.
 
7.4 In the complaint, the User should provide his/her name and surname, address for correspondence, type and date of occurrence of the malfunction related to the functioning of the Advertising Service.
 
7.5 Go-Philippines undertakes to process every complaint within 14 days, and if this is not possible, to inform the User within this period when the complaint will be considered.
 
VIII. Final provisions
 
8.1 The resolution of any disputes arising between Go-Philippines and a User who is a consumer within the meaning of Article 22[1] of the Civil Code shall be submitted to the competent courts in accordance with the relevant provisions of the Code of Civil Procedure.
 
8.2 The resolution of any disputes arising between Go-Philippines and a User who is not a consumer within the meaning of Article 22[1] of the Civil Code shall be submitted to a court having jurisdiction over the seat of Go-Philippines.
8.3 The www.go-philippines.com website contains copyright protected material.
Texts, articles, logos, trademarks, graphics and photographs are protected by copyright. The appearance and layout of the site is the property of the website's creators and is also protected by copyright law. Photographs and their use on the website www.go-philippines.com is subject to license to use them.
 
8.4 Information and prices published on www.go-philippines.com pages do not constitute an offer within the meaning of the Civil Code.
 
8.5 In matters not covered by these Terms and Conditions, the provisions of the Civil Code, the provisions of the Act on rendering electronic services and other relevant provisions of UK law shall apply.
